Invitation to FEF’s Second Annual Bill of Rights Day Event

In December 2023, I posted an article on the FEF website commemorating Bill of Rights Day. Also in December 2023,  FEF hosted in Baltimore its first Free Expression Foundation Bill of Rights Day event. It will soon be time for the second Free Expression Foundation Bill of Rights Day event – on December, 14,  2024 — and you are all invited!

As I noted in my December 2023 article, it is largely due to the skill, perseverance, and historical vision of James Madison that we have our Bill of Rights. Had Madison not risen to the occasion, which was loaded with difficulties — not least opposition from Patrick Henry — there would have been no Bill of Rights,  no ratification of the Constitution by Virginia,  and quite likely no United States of America as we know it. To be sure, the criticisms that can be directed at our Bill of Rights traditions are many and powerful, and in particular the courts’ failures in recent decades to protect the First Amendment rights of the Dissident Right have been disgraceful.  Still, in my judgment we must work within our First Amendment traditions, and if we persevere, as Madison did, we can have a favorable impact.

This year’s FEF Bill of Rights Day event will be held in Pennsylvania jointly with another organization dedicated to speaking truth to power.  At the event, I will provide an update of FEF’s activities in 2024.  In summary here, I believe FEF has made solid progress in 2024 to becoming a force to be reckoned with by those who would use lawfare to suppress freedom of speech and assembly.  FEF’s activities (including my own) have encompassed prosecuting appeals in Idaho and Virginia, filing and arguing a major motion to dismiss in Virginia, filing an Anti-SLAPP action in the District of Columbia, preparing a motion for service by publication against an Antifa in Washington State, mentoring and employing young lawyers and law students, fundraising, increasing FEF’s network of sympathetic lawyers, providing small grants to persons who found themselves in financial distress because of their free speech activities, responding to many inquiries about FBI visits, employment terminations, Jan 6 matters, and other issues, and generally seeking to fulfil FEF’s mission of providing legal, financial, and moral support to persons harmed by their exercise of their First Amendment rights.
